Why Make a Will?

  • According to a recent studies, nearly two thirds of UK adults have not drawn up a Will.

  • This means that their possessions, money, property and even dependent children could be left with someone they have not chosen. 

  • A Will allows you to choose who you want to benefit from your money if you die.

  • It allows you to protect your property to ensure it passes to the right people.

  • Ensure your children are looked after by those you choose rather than those chosen by the Court.

  • Limit claims against your estate - be clear on who you do and do not want to inherit - current research suggests that more than 12.6 million people would seek to challenge the estate of a loved one - everyone has the right to choose how their estate should be distributed.

  • Inform your loved ones of your funeral wishes.

Why make a Lasting Power of Attorney?

  • Whilst a Will deals with your affairs when you die, a Lasting Power of Attorney (LPA) deals with your affairs whilst you are still alive but incapable of handling these for yourself.

  • Incapacity might be temporary or permanent.

  • There are two types of LPA:
    1. Property and Finances; and

       2. Health and Welfare

  • We are living longer and sometimes in poor health - it is likely we will need some form of care in later life.

  • Your next of kin has no power to act on your behalf unless they are appointed as your Attorney.

  • Choose who you want to make decisions for you in the event of an accident or illness.

  • Confirm your wishes regarding life sustaining treatment.

  • Avoid a costly and time consuming Court process.
